Alabama Medical Malpractice Laws

In the state of Alabama a victim of medical malpractice must be able to prove the following in order to win their case:

  • That the doctor, nurse, or other health professional owed them a duty of care
  • That the guilty party failed to provide the care expected to the patient
  • That because of this lack of care, the patient suffered specific harm or injuries that otherwise would not have occurred

The Alabama Medical Malpractice Statute of Limitations

A statute of limitations limits how long after an incident the victim is able to file a lawsuit against the responsible party. In Alabama, victims of medical malpractice may file a lawsuit up to 2 years after the date the malpractice occurred.

There are some exceptions to this law. For example, if the victim could not have reasonably known or discovered the malpractice until after the 2-year period, they will be allowed up to 6 months after the date of discovery to file their lawsuit. However, this extension period is ultimately limited to 4 years after the date the malpractice occurred.
